These terms govern your use of atziproducts.com (the "Site"), operated by Atzi Products ("Atzi," "we," "us") of Glendora, California. By using the Site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site to learn about our products, contact us and, if you have an approved account, view our wholesale catalog. You agree not to:

• use the Site for any unlawful purpose;
• try to get into accounts, catalog pages or systems you are not authorized to use, or test, scan or interfere with the Site's security;
• send false information, spam or harmful code through our forms;
• copy, scrape or republish the catalog, product images or other content, except as these terms allow;
• use the Site in a way that harms Atzi, our customers or other users.

Wholesale accounts

• Accounts are for businesses that buy for resale, such as botanicas and retail stores. They are not for personal purchases.
• The information in your application must be true and complete, and you must keep it up to date.
• We review every application and may approve, decline or later close any account at our discretion.
• Each account is for the business that applied. Keep your password private and do not share your sign-in. You are responsible for activity under your account, and you must tell us right away if you think it has been misused.
• Catalog content available only to approved accounts is confidential business information. Use it only for buying from Atzi and for selling our products in your business.

Pricing and orders

Price lists and ordering terms are provided to approved wholesale accounts. Nothing on the Site is an offer to sell. An order is binding only once we accept it in writing, under the terms we provide with your account.

Product information

We try to describe our products accurately. Product photos and label images are representations. Actual color, fill level, label and packaging may vary slightly from what is shown, and we may update formulas, labels or packaging from time to time. If there is an error on the Site, we may correct it at any time.

Spiritual use

Our products are sold for spiritual use and as curios and novelty items only. No specific result is claimed or guaranteed. They are not intended to diagnose, treat, cure or prevent any disease, and are not a substitute for professional medical, legal, financial or other advice. Descriptions of traditional uses on the Site reflect custom and tradition, not promises of any outcome.

If you resell our products, you agree not to make medical claims or promise results about them, and to keep our labels and disclaimers as supplied.

Intellectual property

The Atzi Products name and logo, our product names, labels, artwork, photos, text and the design of the Site belong to Atzi Products or its licensors and are protected by law. Approved accounts may use our product photos and descriptions only to sell genuine Atzi products, and must not alter them or suggest a partnership that does not exist. Any other use needs our written permission.

If you send us ideas or suggestions, we may use them without any obligation to you.

Links to other sites

If the Site links to other websites, we are not responsible for their content or practices.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available or free of errors. Warranties for products, if any, are only those stated in the terms we provide with an accepted order.

Limitation of liability

To the fullest extent allowed by law, Atzi will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some laws do not allow these limits, so they may not all apply to you.

Indemnity

If your misuse of the Site or breach of these terms leads to a claim against Atzi, you agree to cover the reasonable costs of that claim, including reasonable attorney's fees.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site or these terms will be brought only in the state or federal courts located in Los Angeles County, California, and you and Atzi agree to the jurisdiction of those courts.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we have not waived it. These terms and our Privacy Policy are the entire agreement about use of the Site. Written terms we provide for wholesale orders govern those orders.

Changes to these terms

We may update these terms from time to time. We will post the new version on this page and change the effective date above. Using the Site after the change means you accept the updated terms.
